CHARTER CEPE-0 · CONSOLIDATED TEXT AS RATIFIED
The Charter on the Equality of Persons Beyond Earth
Foundational instrument on the equal rights of every human being offworld
SIGNED AT: Palais des Nations, Geneva
RATIFIED: 2029-12-10
SIGNATORIES: 33 states, 6 orbital station consortia, the International Labour Organization as observer
CUSTODIAN: Offworld Workforce Authority (OWA)
PREAMBLE
Adopted on the anniversary of the Universal Declaration of Human Rights, this Charter acknowledges the fragile threshold of our terrestrial departure and the vast, unforgiving vacuum that defines our new frontiers. The first generation of offworld workers labors under contracts written on Earth for conditions no court on Earth has seen. We affirm that the inherent dignity of the person remains the singular immutable asset of any celestial economy, that the technical necessity of oxygen and pressurized living space shall never constitute a mechanism for subjugation, and that distance from Earth shall never be distance from rights.
Article I — Universality of Rights
Every human being operating beyond the Kármán line retains every right recognized in the Universal Declaration of Human Rights, without exception for vessel, station, employer, flag, or distance. No contract, charter, or emergency may extinguish these rights.
Article II — Equality of Personhood
There shall be no distinction among persons offworld on any ground, including origin, nationality, gender, belief, disability, genetic profile, or the terms of passage under which a person left Earth. A worker who traveled under sponsored passage holds rights equal in every respect to one who paid passage.
Article III — Prohibition of Bonded Labor
Debt bondage, passage indenture, and any arrangement conditioning a person's liberty, air, water, or return on the discharge of a debt are prohibited and void. Life support is never lawful collateral, and any contract conditioning atmospheric maintenance upon active employment is null under the jurisdiction of the Offworld Workforce Authority.
Article IV — Right of Return
Every person offworld retains an unconditional right of return to Earth. Where an employer, authority, or vessel controls the means of return, that party bears the absolute duty to provide it at no cost upon the conclusion or lawful termination of service. Obstruction of transit is prosecuted as unlawful detention.
Article V — Hazard Ledger Disclosure
Every offworld employer shall maintain a publicly accessible Hazard Ledger documenting radiation exposure, gravitational stressors, and deployment terms for each posting. Failure to provide granular, verified safety data constitutes a material breach of this Charter, so that no worker consents to a risk that was not disclosed.
Article VI — Remuneration Parity
Persons performing equal work under equal hazard shall receive equal remuneration, adjusted only by objective, non-discriminatory indices related to physical stressors. Wages shall be paid in liquid assets independent of any company-issued scrip or internal credit system, and the OWA shall enforce parity through mandatory audits of all station payroll nodes.
Article VII — Franchise and Governance
Every permanent resident of an offworld settlement who has attained majority holds the right to participate in the governance of that settlement. No charter may reserve the franchise to shareholders, officers, or sponsoring states.
Article VIII — Remote Judicial Access
Each Party shall provide accessible tribunals, including remote proceedings via low-latency encrypted channels, before which any person offworld may bring a claim under this Charter. The accessibility of justice is a requisite of station operation license renewal.
Article IX — Retaliation Prohibited
Retaliation against a claimant — whether disciplinary action, reduction in life support, or termination of contract — is itself a distinct, actionable breach of this Charter. Protection from retaliation is a non-derogable duty of the OWA.
Article X — Medical Autonomy
All medical interventions, including genetic screening or pharmacological enhancement, require explicit and informed consent without coercion. No entity shall mandate biological modifications as a condition of continued residence or employment.
Article XI — Privacy of Communication
The right to confidential communication with terrestrial authorities and legal counsel is absolute. Data transmission logs shall not be monitored or intercepted by facility operators without a warrant from an independent OWA magistrate.
Article XII — Freedom of Assembly
Persons beyond Earth retain the right to associate, organize, and petition collectively for improved working conditions. Such assemblies shall not be obstructed by proprietary software locks or physical isolation.
Article XIII — Enforcement and Oversight
The Offworld Workforce Authority is mandated to conduct unannounced inspections of all orbital facilities. Any entity found in violation of these articles faces immediate revocation of its operating license and personal liability for administrative officers who directed or tolerated the breach.
Article XIV — Ratification
This Charter enters into force upon the fifteenth ratification. Its protections apply to all persons within a Party's jurisdiction or control, wherever situated in the galaxy.
DEFINED TERMS
- Person Beyond Earth
- Any human being permanently or semi-permanently residing or working outside the terrestrial gravity well of Earth, including crew, migrant staff, and sponsored-passage workers.
- Sponsored Passage
- A transit agreement in which travel costs are fronted by a corporate entity or state in exchange for a term of labor, regulated to prevent predatory debt-trapping; sponsored-passage workers hold rights equal in every respect to self-funded passengers.
- Bonded Labor
- Any arrangement conditioning a person's liberty, air, water, or return on the discharge of a debt; prohibited and void under this Charter, as life support is never lawful collateral.
- Hazard Ledger
- A mandatory, transparent, and immutable record held in the Common Archive detailing gravity, radiation, and deployment terms for each offworld posting, so that no worker consents to an undisclosed risk.
- Right of Return
- The unconditional legal guarantee that every person offworld may return to Earth at no cost, exercisable upon the conclusion or lawful termination of service; where an employer controls the means of return, provision is their duty.
- Remote Tribunal
- A judicial proceeding conducted via asynchronous or low-latency transmission, designed to adjudicate claims across light-delay distances with the same rigor as a terrestrial hearing.
ANNEXES
Annex A — The Hazard Ledger: Minimum Disclosed Fields
The Hazard Ledger must contain, for every work site: localized radiation averages, atmospheric toxicity levels, structural failure history, gravity rating, deployment term, and medical response latency. Each entry requires a cryptographic timestamp and real-time updates by the site's primary supervisor. Failure to disclose any field results in immediate suspension of the site's operating license.
Annex B — Standing Remote-Tribunal Procedure for Light-Delay Jurisdictions
Where light-delay renders live testimony impossible, evidence and statements shall be submitted as pre-recorded high-fidelity streams. Judges must grant a window of at least two round-trip light-time signals before closing the record on any motion. Verdicts are binding only after confirmation of receipt by all involved parties has been archived in the triplicate Common Archive.
